Canada's Anti-Spam Legislation (CASL)

Canada's new Anti-Spam Legislation (CASL), effective July 1, 2014, implies significant changes to the existing electronic marketing practices of Canadian and international businesses. Organizations must prepare now to meet the new rules to ensure compliance by the rapidly approaching deadline, as failure to do so may have serious implications, including the potential imposition of significant fines and possible class action liability.

Communications Group members are leading experts in anti-spam legislation and have been extensively involved at all stages of CASL's consultative and legislative process, helping to secure key amendments to the law. We have assisted clients in understanding the impact on their business, and advised in the development of practical compliance strategies and programs to mitigate their risk in advance of the in-force date of this new law. Our anti-spam experts have advised a wide range of domestic and international clients in regard to all aspects of compliance with CASL, among them retailers, financial institutions, investment firms, broadcasters, internet and telecommunications service providers, auto manufacturers, publishers, charities, trade associations, loyalty programs and insurers and others.

The services our CASL experts provide:

  • Review and analysis of client e-marketing practices, customer intake and transaction processes and client relationship records

  • Assessment of eligibility for various exemptions under law

  • Review of formats for electronic marketing messages and consent requests

  • Assistance with the qualification of existing electronic mailing lists
