Law Practice
Michael Mestinsek is a partner in Stikeman Elliott's Calgary office where he practises in the areas of commercial and insurance litigation. Mr. Mestinsek's expertise in commercial litigation is focused on the areas of shareholders' rights, corporate governance, oil and gas litigation and contractual disputes. His insurance practice is concentrated in the areas of professional negligence, product liability and fire and catastrophic loss cases.
Mr. Mestinsek has developed considerable expertise representing clients in commercial litigation matters involving oppression, shareholders' disputes, directors and officers liability, and in securities litigation matters arising in the context of hostile takeover bids, and stock option backdating.
In his insurance practice, Mr. Mestinsek has represented accountants, financial advisors, engineers and architects, surveyors, brokers, lawyers and directors and officers in respect of professional and directors' and officers' liability matters. He has also developed in-depth expertise and knowledge relating to oil and gas machinery related failures and medical device product liability.
Mr. Mestinsek has represented his clients in the Alberta Court of Queen's Bench and the Court of Appeal of Alberta, various administrative tribunals including the Alberta Securities Commission, IDA and private arbitration proceedings. Mr. Mestinsek is a strong supporter of alternative methods of dispute resolution including mediations, arbitrations and judicial dispute resolution (JDR).

Professional Activities
Mr. Mestinsek is a member of the Canadian and Calgary Bar Associations, the Professional Liability Underwriters Society (PLUS), the Defence Research Institute (DRI) and the Kappa Alpha Literary Society Alumni Association. He is a member of the board for Helios Corporation and the John Hart Hunter Educational Foundation (Canada and U.S.).
He has lectured at the Bar Admission Course and the Legal Education Society of Alberta (LESA) and has given industry presentations and authored articles in the areas of commercial litigation, insurance law, professional liability, corporate governance, shareholders rights and securities litigation.

Background
Mr. Mestinsek attended the University of Alberta until 1993 whereupon he moved to Calgary and articled to The Honourable Associate Chief Justice Neil C. Wittmann.
